LEON KOGLER BIKE COACHING

Terms and Conditions

Version: 7 September 2026. These terms apply to all bookings of mountain bike skills courses with Leon Kogler, Mountainbike-Guide, Michael-Gaismair-Straße 15/37, 6020 Innsbruck ("provider", "I") via the website https://leonkogler.at. Consumers within the meaning of the Austrian Consumer Protection Act (KSchG) are addressed as "participant" or "you". In case of doubt the German version prevails.

1. Services

I offer group courses (fixed dates, 3-8 people at the same level) and private courses (half or full day, day and start time of your choice, up to 8 people) at the locations listed on the website.

Not included: lift tickets and bike park passes, the bike, protective gear, travel, food and insurance. Private courses carry a travel surcharge per location as shown in the price table.

2. Booking and contract

The courses shown on the website constitute an offer. You book by choosing course, date and number of participants, entering your details, accepting these terms and clicking "Book now (payment required)". You then pay right on the website via the payment service Stripe. The contract is concluded upon successful payment; you receive a booking confirmation and the invoice by e-mail.

Until payment your spot is reserved temporarily. If payment is not completed within that time, the reservation lapses at no cost.

Anyone booking for others (e.g. parents for their children) confirms being entitled to do so and ensures all participants meet the requirements in section 7.

3. Booking deadlines

Dates can be booked up to 30 days in advance; dates further out become available once they fall within that window.

Private courses can be booked up to 24 hours before the chosen start time.

Group courses run from 3 people. If the minimum is already reached, the course can be booked up to 1 hour(s) before the start. If your booking brings the course to the minimum, you can book up to 24 hours before. If the course stays below the minimum even with your booking, booking is possible up to 48 hours before the start when someone is already signed up, or 72 hours before when the course is still empty. The applicable deadline is shown when booking.

4. Prices and payment

All prices are final prices in euro. I am a small business under § 6 (1) 27 of the Austrian VAT Act and do not charge VAT.

Payment is made online at the time of booking via Stripe (card, Apple Pay, Google Pay, SEPA direct debit, PayPal, subject to availability). Card data is processed by Stripe only and never stored with me.

4a. Vouchers and discount codes

Gift vouchers are value vouchers purchased on the website and paid online; after payment the voucher is delivered by e-mail as a PDF with a code. It can be redeemed for any course by entering the code when booking. If the course price exceeds the balance, the rest is paid online; any unused balance stays on the code. No cash payout and no interest on the balance. No replacement can be provided if the code is lost or passed on to third parties.

If a booking paid with a voucher is cancelled, the balance used is credited back; any cancellation fee (section 6) is withheld first from the amount paid online and only beyond that from the voucher balance.

Discount codes are valid only for the stated period and scope, cannot be combined with other discount codes and are not paid out.

5. Minimum participants, weather and cancellation by the provider

If the minimum of 3 participants is not reached 24 hours before the course starts, I cancel the course. You are informed by e-mail and receive a full refund.

If safety is at risk (e.g. thunderstorms, snowfall, storm, closed trails, lift closures) or the guide falls ill, I may cancel a course at short notice or change location or time. In case of cancellation you get a full refund or rebook free of charge. Compensation for further expenses (e.g. travel, accommodation, lift tickets) is excluded to the extent permitted by law. Rain alone is not a reason for cancellation.

Refunds are made to the payment method used, via Stripe, usually within 5-10 business days.

6. Cancellation by the participant

Up to 48 hours before the course starts you can cancel free of charge, via the link in your booking confirmation or by e-mail to leon@leonkogler.at. The full course price is refunded.

For cancellations less than 48 hours before the start, a cancellation fee of 50% of the course price applies; the remainder is refunded. In case of no-show or if the participant abandons the course, the full course price is retained.

Note on the right of withdrawal: for services related to leisure activities with a specific date there is no statutory 14-day right of withdrawal (§ 18 (1) 10 FAGG). The cancellation terms described here apply.

Rebooking to another date is possible by arrangement if spots are available; rebooking less than 48 hours before the start is subject to the cancellation terms.

7. Requirements and equipment

Kids courses are for children aged 8 to 14, all other group courses for participants aged 15 and over. Participants must be able to ride a bike safely and be physically fit for a mountain bike course. Health restrictions must be reported to me before the course.

A technically sound mountain bike (in particular working brakes and tyres) and a bicycle helmet are mandatory. Knee and back protectors and gloves are strongly recommended. In case of obviously unsuitable or defective equipment, impairment by alcohol or drugs, or repeated disregard of the guide's instructions, I may exclude participants from the course without refund.

The guide's instructions and the rules of the respective bike parks and trail owners must be followed. Every participant decides for themselves whether to ride a drill or section; nobody has to ride anything they are not comfortable with.

8. Minors

Minors participate only with the consent of a legal guardian; consent is given with the booking by the guardian. Supervision by the guide is limited to the course time at the agreed meeting point. Guardians are responsible for punctual drop-off and pick-up.

9. Risks, personal responsibility and liability

Mountain biking is a sport with an increased risk of falls and injury, even with careful instruction. Participation takes place in awareness of these sport-specific risks and on the participant's own responsibility.

For personal injury I am liable according to statutory provisions. For other damage (in particular damage to your own bike, equipment and clothing, and financial loss) I am liable only in case of intent or gross negligence. This limitation does not apply where prohibited by law.

Participants are liable for damage they cause to other participants, third parties or property according to general rules. Private liability insurance is recommended.

10. Insurance

The course price includes no accident, health or liability insurance. I recommend private accident insurance covering mountain biking and rescue cost insurance. Costs of rescue, recovery and medical care are borne by the participant.

11. Photos and videos

During courses I occasionally take photos or videos, for example for riding technique analysis. For any publication (website, social media, advertising) I ask the persons shown, for minors their guardians, for explicit consent. Nothing is published without consent; consent can be withdrawn at any time with future effect.

12. Data protection

Information on how your data is processed can be found in the privacy policy on this website.

13. Final provisions

Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers the mandatory provisions of the KSchG apply; the competent court is determined by § 14 KSchG. For businesses the place of jurisdiction is Innsbruck.

Dispute resolution: I am neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board. For questions or complaints contact me at leon@leonkogler.at.

Should individual provisions of these terms be invalid, the validity of the remaining provisions is not affected.
